Shanghai to Further Strengthen the Management of Road Transportation and Storage of Dangerous Goods (Hazardous Chemicals)

On July 28, 2022, the Shanghai government published a notice regarding the road transportation and storage of dangerous goods in the municipality. The notice came into force on August 15, 2022.

This notice was published to ensure safe and orderly operation within the city, and ensure the safety of people’s lives and properties. It was drafted based on:

  • the Work Safety Law of the People's Republic of China,
  • the Regulations on the Safety Management of Hazardous Chemicals,
  • the Measures for the Administration of Road Transportation Safety of Dangerous Goods,
  • the Provisions on the Administration of Road Transport of Dangerous Goods,
  • the Measures for the Dynamic Supervision and Administration of Road Transport Vehicles, and
  • the Measures of Shanghai Municipality for the Safety Administration of Hazardous Chemicals.

The notice contains the following information:

I. Consignors, carriers, consignees, and receivers handling dangerous goods (hazardous chemicals) shall inspect the production, storage, use, operation, transportation qualifications, and other transportation information in strict accordance with laws and regulations. They must keep relevant documents and establish accounts for verification. And in case of any problems, they must immediately report to the competent departments concerning transportation, emergency, and public security management.

II. Shanghai implements digital supervision of road transportation of dangerous goods (hazardous chemicals) via a management system  that tracks the road transportation of dangerous goods (hazardous chemicals) (hereinafter referred to as “dangerous goods transportation management system”, on its website https://www.coolzsr.com/). Vehicles entering and leaving the city while transporting dangerous goods (hazardous chemicals) will be subject to inspection by system.

III. It is highly recommended that consignors use a Contract for Shanghai Road Transportation of Dangerous Goods when entering into a transportation contract (a sample can be downloaded from the dangerous goods transportation management system). Consignors must provide an electronic or written consignment list that specifies relevant information concerning dangerous goods such as the:

  • consignor,
  • carrier,
  • consignee,
  • loader,
  • departure and destination location,
  • category,
  • item,
  • product name,
  • UN number,
  • packaging and specification,
  • quantity, and
  • emergency telephone number.

They must also include the hazard property/properties, transportation precaution(s), first aid measures, fire prevention measures, emergency disposal measures in case of a leak, and disposal measures in case of secondary environmental pollution.

The consignor must keep the duplicates of the carrier’s business license or filing certificate for road transportation of dangerous goods together with the transportation contract, and confirm the carrier’s level of “safety assessment” and “evaluation on safety operation” on the dangerous goods transportation system to avoid safety risks.

IV. Carriers of dangerous goods (hazardous chemicals) must require their consignors to provide qualification certificates such as the production/ operation license and the business license of hazardous chemicals when signing the contract. They must keep the duplicates together with the transportation contract, and check whether the consignor has the correct qualifications for the production and operation of hazardous chemicals via the dangerous goods transportation management system.

V. According to the relevant regulations, carriers must submit the “Electronic Shipping Order” before the transportation of dangerous goods (hazardous chemicals). The names, UN number, CAS number of dangerous goods (hazardous chemicals), and the full names of consignees and receivers must be filled in subject to the specifications. The driver must carry, and keep safe, the electronic shipping order prepared by the carrier.

VI. Carriers from other provinces engaged in dangerous goods (dangerous chemicals) transportation in Shanghai shall report to the Shanghai Municipal Road Transport Administrative Bureau when operating and transporting for more than three months (if the location of dispatch and receipt are both within Shanghai). If the location of departure or destination is within Shanghai, the carrier will be subject to the inspection of the dangerous goods transportation management system instead of the Shanghai Municipal Road Transport Administrative Bureau.

VII. The dangerous goods transportation management system collects all electronic shipping orders of vehicles that carry dangerous goods registered and operated in Shanghai via the Electronic Shipping Order Interactive System under the Ministry of Transport. The system will automatically compare and verify the qualifications and transportation information of vehicles that carry dangerous goods, and send the qualified electronic shipping order and relevant data to consignees and receivers. The system will not send the unqualified electronic waybills or data unless the carrier supplements the relevant information according to laws and regulations.

VIII. Enterprises that produce, store, transport, use, and operate dangerous goods (hazardous chemicals) shall establish and improve an inspection and recording system for filling or loading dangerous goods, and strictly implement it. Shippers must verify the information of the vehicles, personnel, tanks, and shipping orders based on the “Five Essentials Checklist”  before filling and loading dangerous goods. Vehicles are allowed to enter the operating area to fill or load dangerous goods (hazardous chemicals) only after inspection via the system. Vehicles that do not have inspection information in the system or have not passed the inspection are not allowed to enter the operating area. The consignors must not fill or load dangerous goods (hazardous chemicals) onto those vehicles and then mark the failed inspection matters and reasons in the system. It is imperative for consignors to actively perform the “Five Essentials Checklist”.

(The Five Essentials Checklist refers to checking whether the vehicles have a valid driving and operation permit; whether the drivers and the cargo attendants have obtained valid qualifications; whether the transportation equipment is qualified and within the validity period; whether the transported dangerous goods are consistent with the information recorded in the shipping order; and whether the dangerous goods in the tank fall within the scope.)

IX. All units must strictly implement requirements under this Notice. Any violation of the above-mentioned provisions or any illegal behavior and irregularities must, by law, be investigated by the competent departments. All district People’s governments in Shanghai must fulfill their supervision and administrative responsibilities and enhance their supervision within their jurisdictions.

X. All management departments must publicize, explain, and provide training to the relevant enterprises, establishing an information disclosure, and service hotline for consultation.
